Please read these Terms and Conditions carefully before using www.dentterity.com or placing an order.

By accessing the website, creating a customer account, or placing an order, you acknowledge that you have read and understood these Terms and Conditions and agree to be bound by them.

If you do not agree with these Terms and Conditions, please do not use the website or place an order.

These Terms and Conditions govern the use of the Dentterity website and the contractual relationship between Dentterity and its customers.

They should be read together with:

  • the Privacy Policy;

  • the Cookie Policy;

  • the Refund Policy;

  • the Shipping Policy;

  • the Warranty Policy;

  • the Copyright and Intellectual Property Policy;

  • any other policies made available on the website.

Dental Retreat Agency SRL operates the Dentterity brand and online store.


2. Definitions

For the purposes of these Terms and Conditions:

Website means the online store available at www.dentterity.com.

Dentterity, we, us, or our means Dental Retreat Agency SRL, the company operating the website and selling the products available through it.

Customer means any natural or legal person who uses the website, creates an account, or places an order.

Consumer means a natural person acting for purposes outside their trade, business, craft, or profession, as defined by applicable consumer protection legislation.

Business Customer means a company, sole trader, professional, or other entity purchasing products for purposes related to its professional or commercial activity.

Account means the personal customer account created on the website, where available.

Product means any physical or digital product offered for sale by Dentterity.

Order means a request submitted by a customer through the website to purchase one or more products.

Contract means the distance sales contract concluded between Dentterity and the customer.

Promotional Code / Discount Code means a code issued or authorized by Dentterity that may provide a discount or other commercial benefit subject to the conditions applicable to the relevant promotion.


3. Scope

These Terms and Conditions govern the use of the Dentterity website and purchases made through it.

By using the website, customers confirm that they have the legal capacity required to enter into transactions and make purchases.

Use of the website for unlawful purposes or in violation of these Terms and Conditions is prohibited.

Mandatory rights granted to consumers under applicable law are not affected by these Terms and Conditions.


4. Acceptance of These Terms

By placing an order through the website, the customer agrees to the Terms and Conditions applicable at the time the order is placed.

Dentterity may update these Terms and Conditions when reasonably necessary, including to reflect changes in legislation, our services, payment methods, delivery options, or website functionality.

Any updated version will apply from the date on which it is published and will not retroactively alter orders already concluded.


5. Customer Accounts

Where available, customers may place orders with or without creating an account.

When creating an account, customers are responsible for:

  • providing accurate, complete, and up-to-date information;

  • maintaining the confidentiality of their login credentials;

  • preventing unauthorized access to their account;

  • informing us if they become aware of suspected unauthorized use.

Dentterity may suspend or restrict accounts that are reasonably suspected of being used fraudulently, unlawfully, or in material breach of these Terms and Conditions.


6. Placing an Order

Products may be ordered through the website.

Adding a product to the shopping cart does not reserve the product or guarantee its availability.

After an order is placed, the customer may receive an automated order confirmation by email.

An automated acknowledgement of an order does not necessarily constitute final acceptance of the order.

Dentterity may carry out reasonable checks before accepting an order, including checks relating to payment, delivery information, product availability, suspected fraud, or obvious technical errors.

A sales contract is concluded when the order is accepted by Dentterity in accordance with the ordering process communicated to the customer.

Nothing in this section affects mandatory consumer rights applicable to the formation or performance of distance contracts.


7. Product Availability

Products are offered subject to availability.

If a product becomes unavailable after an order has been placed, Dentterity will inform the customer as soon as reasonably possible.

Depending on the circumstances, we may offer:

  • an alternative product, subject to the customer's agreement;

  • a later delivery date;

  • cancellation and reimbursement of amounts already paid for the unavailable product.


8. Prices and Currencies

Prices are displayed in the currency applicable to the customer's selected market or location, where supported by the website.

Depending on the market, prices may be displayed in RON, EUR, GBP, USD, or other supported currencies.

The final price applicable to an order, including any applicable taxes and shipping charges, will be displayed before the customer submits the order.

Taxes are applied in accordance with applicable legislation and the customer's destination.

Dentterity takes reasonable measures to ensure that prices are displayed accurately.

If an obvious technical or pricing error occurs, such as a clearly incorrect price resulting from a system or data-entry error, Dentterity may contact the customer and, where legally permitted, cancel the affected order before dispatch. Any amount already collected for a cancelled order will be reimbursed.


9. Promotional Codes and Commercial Campaigns

Dentterity may periodically offer promotional campaigns, referral codes, affiliate codes, or discount codes.

Unless otherwise stated for a specific promotion:

  • promotional codes may be subject to eligibility requirements;

  • only the permitted number of codes may be applied to an order;

  • codes may not be combined where the applicable promotion does not permit combination;

  • codes cannot be exchanged for cash;

  • codes are valid only during the stated validity period;

  • codes may apply only to selected products, customers, markets, or order values;

  • codes generally cannot be applied retroactively to completed orders.

Dentterity may refuse or cancel a promotional benefit where there is reasonable evidence of fraud, abuse, unauthorized code distribution, exploitation of a technical error, or other misuse.

This does not affect any mandatory consumer rights.


10. Payment Methods

Available payment methods are displayed during checkout and may vary depending on the customer's country, market, or delivery method.

Depending on availability, payment methods may include:

  • debit or credit card;

  • Cash on Delivery (COD);

  • bank transfer;

  • digital wallets;

  • other payment methods made available through Shopify or authorized payment providers.

Cash on Delivery is available only for eligible destinations and delivery methods displayed at checkout.

Online payments are processed through authorized payment service providers. Dentterity does not store or have access to complete payment card details.

Where payment authorization is required and payment cannot be authorized or processed, the order may not be accepted or dispatched.


11. Invoicing

Invoices are issued in accordance with applicable fiscal legislation.

Invoices are prepared using the information provided by the customer when placing the order.

Customers are responsible for checking that billing information is accurate before completing their purchase.

Changes to fiscal information after an invoice has been issued may only be made where and to the extent permitted by applicable law.

Invoices may be issued and delivered electronically.


12. Shipping and Delivery

Dentterity currently offers delivery to Romania, European Union member states, the United Kingdom, and selected international destinations.

Available destinations, delivery methods, shipping charges, and any relevant information are displayed at checkout.

Orders are delivered through third-party carriers and/or fulfilment partners.

Estimated delivery times may vary depending on:

  • destination;

  • product availability;

  • order volume;

  • selected delivery method;

  • carrier operations;

  • customs procedures;

  • public holidays;

  • circumstances beyond Dentterity's reasonable control.

Nothing in these Terms limits any mandatory statutory rights relating to delivery.


13. Receipt of Products

Customers are encouraged to inspect parcels and products upon receipt.

If the packaging appears visibly damaged, customers should, where reasonably possible:

  • inspect the contents;

  • document the damage with photographs;

  • report visible damage to the carrier;

  • contact Dentterity as soon as possible.

Failure to perform these recommended checks does not remove statutory consumer rights.


14. Transfer of Risk

For consumers, the risk of accidental loss or damage generally passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the products, subject to applicable law.

Nothing in these Terms modifies mandatory rules regarding the transfer of risk.


15. Right of Withdrawal and Returns

Consumers purchasing at a distance have a statutory right to withdraw from eligible contracts within 14 calendar days, without having to provide a reason, subject to the conditions and exceptions established by applicable law.

The withdrawal period generally begins when the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.

Customers wishing to exercise their right of withdrawal must communicate their decision within the applicable period.

For returns resulting from a change of mind or another reason not attributable to Dentterity, the customer bears the direct cost of returning the goods.

The customer may select a suitable carrier and pay the return shipping cost directly to that carrier.

Return parcels must not be sent Cash on Delivery to Dentterity.

Where the return results from an issue attributable to Dentterity, such as an incorrect, defective, incomplete, or transport-damaged product where Dentterity is legally responsible, Dentterity will bear the necessary return costs in accordance with applicable law.

16. Refunds Following Withdrawal

Where a consumer validly exercises the statutory right of withdrawal, Dentterity will reimburse the amounts due in accordance with applicable consumer protection legislation.

Where required by law, this includes the cost of the standard delivery method originally offered by Dentterity.

If the customer expressly selected a delivery method that was more expensive than the standard delivery option, Dentterity is not required to reimburse the additional cost resulting from that choice, to the extent permitted by law.

Dentterity may withhold reimbursement until the returned goods have been received or until the consumer provides evidence that the goods have been sent back, whichever occurs first, where permitted by applicable law.

17. Product Conformity and Warranty

Products sold by Dentterity benefit from the statutory conformity rights and guarantees applicable under relevant consumer protection legislation.

Nothing in these Terms limits or excludes statutory rights relating to defective or non-conforming goods.

18. Educational Products

Dentterity products are educational materials designed to support learning, training, and the development of practical skills.

Unless expressly stated otherwise, Dentterity products do not replace:

  • university or professional education;

  • supervised practical training;

  • instruction from qualified teachers or professionals;

  • professional literature;

  • clinical training;

  • medical or dental advice;

  • professional judgment.

Dentterity does not guarantee specific academic, clinical, professional, or performance outcomes from the use of its products.

Products must be used responsibly and in accordance with their intended educational purpose.


19. Intellectual Property

The content of the website and Dentterity products may include intellectual property owned by Dentterity and/or third parties who have authorized its use.

Protected materials may include, without limitation:

  • educational materials;

  • workbooks;

  • exercises;

  • texts;

  • illustrations;

  • graphics;

  • photographs;

  • layouts;

  • product designs;

  • website content;

  • product descriptions;

  • videos;

  • logos;

  • brand elements and visual identity.

Purchasing a Dentterity product does not transfer intellectual property rights in its content.

Except where permitted by applicable law or expressly authorized in writing, users may not reproduce, scan, copy, distribute, publish, commercially exploit, or otherwise use protected Dentterity content beyond the rights associated with legitimate personal use of the purchased product.

20. Artificial Intelligence and Automated Use

To the extent permitted by applicable law, Dentterity reserves its rights regarding the use of its protected content for purposes including:

  • training artificial intelligence models;

  • machine learning;

  • large language models;

  • generative AI systems;

  • creation of datasets for AI development;

  • automated content generation;

  • commercial AI-based products or services.

Where applicable law permits rights holders to reserve rights against text and data mining, automated extraction, or similar uses, Dentterity expressly reserves such rights.

Nothing in this section restricts uses that cannot lawfully be prohibited under applicable legislation.


21. Reviews and User-Generated Content

The website may allow customers to submit product reviews, ratings, or other content.

Dentterity may moderate, refuse, or remove content that:

  • contains unlawful, abusive, threatening, or offensive material;

  • contains false or misleading information;

  • infringes third-party rights;

  • contains another person's personal information without authorization;

  • constitutes spam or unauthorized advertising;

  • is unrelated to the product or service being reviewed;

  • otherwise violates applicable law or these Terms.

Dentterity will not alter legitimate customer opinions solely because they are negative.

Where the website identifies reviews as verified or originating from verified purchasers, such claims will be made in accordance with the functionality and verification mechanisms available through Shopify and/or the review services used by Dentterity.


22. Acceptable Use of the Website

Users must use the website lawfully and in good faith.

Users must not:

  • use the website for illegal activities;

  • introduce viruses, malware, or other harmful code;

  • attempt unauthorized access to systems, accounts, servers, or databases;

  • interfere with the operation or security of the website;

  • impersonate another person;

  • provide deliberately false or misleading information;

  • systematically copy or extract protected website content in violation of applicable law or Dentterity's rights.

Dentterity may take reasonable measures to protect the website, customers, and its systems from fraud, abuse, attacks, or unauthorized use.


23. Limitation of Liability

Dentterity takes reasonable measures to ensure that information available on the website is accurate and that its services operate correctly.

However, temporary technical errors, interruptions, maintenance periods, or circumstances beyond our reasonable control may occur.

To the maximum extent permitted by applicable law, Dentterity is not liable for losses resulting solely from:

  • temporary website interruptions;

  • temporary unavailability of particular services;

  • failures attributable to third-party internet or infrastructure providers;

  • carrier disruptions;

  • events outside Dentterity's reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, nor does it limit mandatory consumer rights.


24. Events Beyond Our Reasonable Control

Dentterity will not be responsible for failure or delay in performing an obligation where that failure or delay results from circumstances beyond its reasonable control, to the extent permitted by applicable law.

Such circumstances may include:

  • natural disasters;

  • extreme weather;

  • fires or floods;

  • armed conflicts;

  • epidemics or pandemics;

  • strikes or significant labor disputes;

  • acts or restrictions imposed by public authorities;

  • major transportation, communication, or energy disruptions.

Affected obligations may be suspended for the duration of the relevant event where legally permitted.


25. Refusal, Suspension or Cancellation of Orders

Before dispatch, Dentterity may refuse, suspend, or cancel an order where there is a legitimate reason to do so, including where:

  • information provided by the customer is materially incomplete or incorrect;

  • there are reasonable grounds to suspect fraud;

  • required payment has not been authorized or received;

  • the product is unavailable;

  • an obvious technical pricing error has occurred;

  • a promotional code or campaign has been fraudulently or improperly used;

  • fulfilment of the order would violate applicable law.

If Dentterity cancels an order for which payment has already been received, the amount due will be reimbursed in accordance with applicable law.


26. Communications

By placing an order or creating an account, customers agree to receive communications reasonably necessary to administer their account or perform the contract, including:

  • order confirmations;

  • payment information;

  • shipping and tracking updates;

  • information relating to returns or refunds;

  • warranty or conformity communications;

  • customer support responses.

These are transactional or operational communications.

Marketing communications are sent only in accordance with applicable data protection and electronic communications legislation and, where required, on the basis of the customer's consent.


27. Personal Data

Personal data is processed in accordance with applicable data protection legislation, including the General Data Protection Regulation (EU) 2016/679 (GDPR) where applicable.

28. Changes to These Terms

Dentterity may update these Terms and Conditions where reasonably necessary, including to:

  • comply with legislative or regulatory changes;

  • introduce new website functionality;

  • modify services, payment methods, or delivery options;

  • improve the contractual framework applicable to the website.

The updated version will be published on the website and will apply from the stated effective date.

Changes will not retroactively alter the terms applicable to orders already concluded, except where required by law.


29. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.


30. Governing Law and Consumer Rights

These Terms and Conditions and contracts concluded with Dentterity are governed by Romanian law, subject to any mandatory consumer protection rules that apply to the customer.

If you are a consumer residing in another country, this choice of law does not deprive you of any mandatory consumer protection rights that you are entitled to under the laws applicable to you and that cannot lawfully be excluded by agreement.

Dentterity and the customer are encouraged to attempt to resolve disputes amicably in the first instance.

Where an amicable resolution is not possible, disputes may be submitted to the competent courts in accordance with applicable rules on jurisdiction.

Nothing in these Terms restricts a consumer's right to use any competent consumer protection authority, alternative dispute resolution mechanism, or other remedy available under applicable law.
